The Trump Administration Seeks Supreme Court Clearance for National Guard Troop Deployment in Chicago Area
On Friday, the White House petitioned urgently to the federal top court, asking for clearance to station military reserve personnel to Illinois.
This action is part of a larger push to expand the domestic use of the troops in multiple urban centers under Democratic control.
Court Fight Over Troop Deployment
In an emergency filing, the US Department of Justice urged the bench to set aside a lower court ruling that had halted the sending of hundreds of state guard troops to the Chicago region.
The district judge had expressed skepticism about the administration's justification for deploying forces, doubting its explanation in considering local conditions.
A higher court affirmed the previous order on Thursday, leaving the deployment on standby while the legal challenge continues.
Government's Claims
The top government lawyer, speaking on behalf of the administration, claimed in the new filing that federal law enforcement have often been “menaced and assaulted” in the city of Chicago and the neighboring town of Broadview.
This location is home to an federal immigration detention center.
The former president has earlier dispatched state guard units to the Windy City and Portland, subsequent to prior sendings to Los Angeles, California, the city of Memphis, and Washington DC.
The White House has stated that troop deployment is required to reduce protests and support deportation efforts.
Partisan Opposition
Opposition leaders have vehemently criticized the move, saying that the White House's statements are overstated and driven by politics.
They charge the administration of exploiting his power to punish opponents.
The judiciary have also raised questions about the government's portrayal of events.
City officials say that protests over immigration enforcement have been largely small and peaceful, challenging the former president's characterization of “combat area” circumstances.
Statutory Grounds
At the center of the dispute is the administration's application of a national law authorizing the commander-in-chief to take control of the state guard only in instances of rebellion or when “powerless with the standard military to enforce the laws of the United States”.
The government insists that the forces are necessary to protect government buildings and officers from demonstrators.

In recent weeks, the administration took control of several hundred troops of the state guard of Illinois and commanded additional Texas national guard personnel into the Illinois.
As state authorities condemned the decision, the former president increased his statements, urging the detention of the mayor of Chicago and the Illinois governor, both Democrats, charging them of failing to protect ICE personnel.
Illinois and municipal government together took legal action against the administration to halt the activation.
On the ninth of October, Judge April Perry, nominated by President Biden, issued a temporary injunction stopping the command.

Simultaneously in the city, at least a dozen people were taken into custody outside the ICE facility in Broadview following serious disputes between state law enforcement and protesters.
